2. Our contract with you

2.1  These terms and conditions apply:

 

2.1.1   so far as the context allows, to you as a visitor to the Web Site; and

 

2.1.2   in any event to you as a Member or prospective Member of our Website to avail the Service.

 

2.2  The scope of these terms and conditions are to govern the legal relationship between you and us as arising out of paragraph 2.1. The relationship between the Members inter se and with the asset provider of the scheme will be governed by a separate agreement as may be entered among them.

 

2.3  The Syndicate Scheme as Posted may not be available and we may offer you an alternative in that case.

 

2.4  By using the Website, you warrant and represent to us that you have not been declared insolvent or subjected to an insolvency proceeding or convicted of any offence relating to financial crime, violence, theft or fraud or subject to any injunction or order to pay damages under the Thefts Acts 1968-1996 (as amended from time to time) or under any other statutory enactment as may be applicable in addition to any offence that may disqualify you from participating in any Syndicate Scheme as per our discretion.

 

2.5  Your membership with us is not a guarantee to secure booking in a desired Syndicate Scheme which may depend upon other factors beyond our control such as completion of desired number of persons for such scheme, your negotiation with other Members etc.

 

2.6  We shall accept your booking for the desired Syndicate Scheme by e-mail confirmation. Our message will also confirm details of your entitlement in addition to other relevant requirements and information.  It is possible that the price to participate in any Syndicate Scheme may have increased from that posted on our Website.

 

2.7  All descriptions and appearance of the assets over the Website relating to the Syndicate Scheme are those of the Members or our associates or the dealers of original manufacturers and you may not rely on their accuracy.  Accordingly, any such description shall not form part of these terms and conditions.

 

2.8  We reserve the right to vary these terms and conditions at any time. If so, the updated version will be posted on the Website and we will notify you by e-mail. You will be deemed to have accepted the updated version if you continue to use the Service beyond 7 days after such mail.

 

2.9  Our associates, employees, agents and dealers are not authorised to make any representations or warranties concerning the Service unless confirmed by us in writing.

 

2.10  We reserve the right, at our sole discretion to:

 

2.10.1  refuse your application for membership;

 

2.10.2  monitor and edit the Content and to remove the Postings from the Website without any prior notice; and

 

2.10.3  cancel, suspend or terminate your membership at any time;

 

2.10.4  to withdraw or modify any Syndicate Scheme or the Service where we have a valid legal or commercial reason.
